Online shop terms and conditions

Rules for orders, personalisation, payments, delivery and customer rights.

§ 1. Seller and scope

The harcerz.pl online shop, available at harcerz.com.pl, is operated by Morowo - Bartosz Borowiec, with its registered address at ul. Łódzka 153, 95-054 Ksawerów, Poland, tax ID (NIP): 7311041401, entered in the Polish Central Register and Information on Economic Activity (CEIDG); REGON business ID: 100753742, hereinafter the “Seller”. Contact: zamowienia@harcerz.pl, phone 786 895 179. Address for complaints and returns: Morowo - Bartosz Borowiec, ul. Łódzka 153, 95-054 Ksawerów, Poland.

These terms govern use of the website, orders for personalised scouting accessories, payments, delivery, withdrawal and complaints. The language of the contract is Polish. These terms can be saved and printed free of charge before a contract is concluded.

A consumer is a natural person acting for purposes not directly related to their business or professional activity. Provisions on withdrawal and non-conformity also apply, to the extent provided by law, to a natural person concluding a contract directly related to their business where the contract is not professional in nature for that person, in particular in light of the business activities disclosed in CEIDG. If the nature of the contract is not apparent from its content, that person may declare its professional or non-professional nature no later than at conclusion. Concluding the contract is not conditional on making that declaration.

§ 2. Website use and electronic services

The website provides free access to the offer and to the designer at harcerz.com.pl/kreator. Use requires an internet-connected device and an up-to-date browser supporting HTML, CSS and JavaScript; correspondence requires an active email account. Reading the documents does not require an account or marketing consent. Browsing can be ended by closing the page.

Customers must not provide unlawful content. When submitting artwork, they should have the rights necessary to use it on the product ordered. The Seller uses customer materials to prepare and fulfil the order; use in advertising requires a separate agreement.

Technical issues and complaints about electronic services can be reported to zamowienia@harcerz.pl, with a description of the problem and contact details. The Seller responds to a consumer complaint within 14 days of receipt.

§ 3. Placing orders and concluding contracts

Submitting the final form in the designer constitutes placing an order, rather than merely requesting a quote. Before submitting it, customers review and can correct their design, quantities, contact and delivery details, and payment method. The summary states the full price in PLN including taxes, delivery charges, the fulfilment time and any applicable statutory exemption from the right of withdrawal.

The final button for an order requiring payment clearly indicates the obligation to pay, for example “Order with obligation to pay”. Registering the submission in the system and starting production are separate steps.

Conclusion of the contract: the order is the customer's offer. We confirm the Seller's acceptance and the conclusion of the contract by email. For deferred payment, acceptance requires prior approval of the request. An automatic message acknowledging receipt of the form alone does not confirm approval of deferred payment.

The confirmation of the contract includes its terms, the approved specification, price, fulfilment time and these terms and conditions on a durable medium, for example in the email or an attachment. A link to a page that can change does not replace a durable record. Changes to agreed terms require the customer's agreement.

§ 4. Personalisation and production

The specification may include one or two fabric colours, binding, the number and colours of ribbons, and custom embroidery or DTF printing. Embroidery is applied directly to the product as the final stage of production.

The customer checks the visual preview, including spelling, symbols, colours and placement. The Seller makes the product according to the approved design. Approving the visual preview does not remove the customer's right to complain or release the Seller from responsibility for conformity with the contract.

Design changes agreed after conclusion of the contract may affect the price or deadline only with both parties' agreement. Questions about colour reproduction should be resolved before production; possible technical differences do not constitute a general exclusion of liability for the product.

Approval of the visual preview remains part of agreeing the design. If changes needed after ordering affect production time, we agree a new deadline with the customer; we do not extend it unilaterally.

§ 5. Payments and the start of production

Choose from the payment methods available when placing your order: online payment through Przelewy24, a traditional bank transfer based on a pro forma invoice, or deferred payment following individual approval.

If Przelewy24 is available when ordering, the customer pays directly during the order process. For a traditional bank transfer, the bank account, amount and payment deadline are stated on the pro forma invoice sent to the customer.

  • Przelewy24, if available: the production period starts on the day the order is placed and receipt of payment is confirmed. Starting a transaction, or an unsuccessful transaction, does not count as payment.
  • Bank transfer / pro forma invoice: the production period starts on the day the funds reach the Seller's bank account.
  • Deferred payment: once the request is approved, we count the production period from the date the order was placed, without waiting for payment. If this payment arrangement is declined and the order is not accepted for fulfilment, we notify you by email. Any switch to advance payment must be agreed with the customer.

We assess requests using your order history and the timeliness of previous payments. For a first order, we may ask you to email zamowienia@harcerz.pl a scan of a declaration signed by the treasurer or responsible person, committing to meet the payment deadline. Submitting this declaration does not guarantee approval. We confirm deferred payment terms individually.

A request for deferred payment is declined before the order is accepted for fulfilment on that basis and before a contract is concluded under § 3. The Seller does not reserve a right to arbitrarily cancel a contract already concluded. Non-payment under an existing contract is addressed in accordance with its terms and the law.

§ 6. Delivery and collection

Delivery to an address is by DHL or InPost courier. Parcel locker delivery is exclusively to InPost parcel lockers. Delivery area: Poland only. Charges: DHL — PLN 10; InPost courier — PLN 10; InPost parcel locker — PLN 10. Delivery is free when the products in the order total at least PLN 300.

Production normally takes up to 2 weeks, depending on the design's complexity. During busy periods it may take longer; we confirm the specific time individually before concluding the contract. Transit is expected to take 1–2 business days after dispatch of the finished order. The final delivery deadline and the event from which it is counted are agreed before the contract is concluded. Delivery charges form part of the price summary before ordering. Collection is not offered in the designer. Any collection arrangement is discussed by phone and must be agreed individually.

If a parcel is damaged, documenting its condition is helpful. A damage report or inspection in the courier's presence is not a condition for accepting a consumer complaint. Where delivery is by a carrier offered by the Seller, the risk of accidental loss or damage passes to the consumer when the goods are handed over to them.

§ 7. Withdrawal — products without a statutory exemption

A consumer may withdraw from a distance sales contract within 14 days without giving a reason, unless the statutory exception in § 8 applies. For a single item, the period begins when the consumer or a person designated by them, other than the carrier, takes possession. For one contract covering separately delivered goods, batches or parts, it begins on receipt of the last item, batch or part.

It is sufficient to send an unambiguous withdrawal statement before the deadline, for example to zamowienia@harcerz.pl or to Morowo - Bartosz Borowiec, ul. Łódzka 153, 95-054 Ksawerów, Poland. The form at the end of these terms may be used but is not mandatory. No reason or consent from the Seller is required.

Goods must be returned no later than 14 days after the withdrawal statement. The customer bears the direct return cost if informed of this. The Seller refunds payments received, including the cost of the least expensive standard delivery option offered for that order, within 14 days of receiving the statement. Refunds use the original payment method unless the customer expressly agrees to another method that incurs no fees for them.

The Seller may withhold reimbursement until receiving the goods or evidence of their return, whichever occurs first, unless the Seller has offered to collect them. The customer is responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Original packaging or a receipt is not an absolute condition for exercising withdrawal.

§ 8. Personalised products and voluntary exchanges

The right to withdraw without giving a reason does not apply to non-prefabricated goods made to the consumer's specifications or to meet their individual needs, under Article 38(1)(3) of the Polish Act of 30 May 2014 on Consumer Rights.

The exemption may apply in particular to a neckerchief made to an individually agreed design with custom embroidery or printing. Customers are informed before concluding the contract when the exception applies to a particular product. Merely calling a product “personalised”, or selecting a ready-made stock variant, does not in itself remove the statutory right.

The shop does not offer voluntary exchanges of correctly made personalised products because a customer changes their mind. Any voluntary exchange of other products requires a separate agreement and does not replace the right of withdrawal.

These restrictions do not apply to complaints about non-conformity. Customers retain their rights if goods do not conform to the contract, including repair or replacement and, in the cases prescribed by law, a price reduction or withdrawal and a refund.

§ 9. Complaints and conformity with the contract

The Seller is liable to a consumer for non-conformity existing on delivery and becoming apparent within two years of that date, unless a stated shelf life is longer. Statutory rules apply, including presumptions about when the non-conformity existed. This protection also covers personalised goods.

A consumer may request repair or replacement. The Seller may change the remedy or refuse it only as allowed by law, for example if it is impossible or would involve excessive costs. Repair or replacement must take place within a reasonable time, without significant inconvenience and at the Seller's expense; the Seller collects the goods at its own expense.

In the cases set out in Article 43e of the Act, including an unsuccessful remedy, refusal, continuing non-conformity or sufficiently serious non-conformity, the customer may request a price reduction or withdraw from the contract. Withdrawal is not available for minor non-conformity; the Act presumes that non-conformity is significant. Return costs following withdrawal due to non-conformity are borne by the Seller.

A complaint may be submitted in any legally permitted form, in particular by email to zamowienia@harcerz.pl or to Morowo - Bartosz Borowiec, ul. Łódzka 153, 95-054 Ksawerów, Poland. It is helpful to identify the purchase, describe the problem and requested remedy, and provide contact details. Photos can help, but the absence of photographs, a receipt or original packaging does not invalidate a complaint.

The Seller responds to the consumer within 14 days of receiving the complaint, on paper or another durable medium. No response within that period means the complaint is accepted. A refund resulting from a price reduction is made without delay, no later than 14 days after receipt of the statement; for withdrawal due to non-conformity, no later than 14 days after receiving the goods or evidence of their return.

For customers not covered by consumer protection, the relevant provisions of the Polish Civil Code apply. These terms do not introduce an additional exclusion of statutory warranty liability.

§ 10. Out-of-court dispute resolution

Consumers may seek help from a municipal or district consumer ombudsman and information on out-of-court dispute resolution at polubowne.uokik.gov.pl, including proceedings before the relevant provincial Trade Inspection authority. Participation is governed by the rules of the applicable procedure.

If a complaint does not resolve a dispute, the Seller provides the consumer, on a durable medium, with the legally required statement on participation in out-of-court proceedings and the competent body. These provisions do not restrict the right to bring a case before a competent court.

§ 11. Personal data and final provisions

Information about data processing and storage technologies is provided in the privacy policy. Accepting these terms does not constitute marketing consent.

Data retention periods

  • Tax documentation is generally retained for 5 years from the end of the calendar year in which the tax payment deadline fell, subject to statutory extensions. Other accounting records are retained for the period required by the applicable rules.
  • We retain order documentation, the approved visual preview, confirmations and relevant correspondence during fulfilment of the contract and then until the applicable limitation period for claims expires. The general six-year period is a reference point, not an automatic retention period for all data: we apply the special periods relevant to the claim and the rules determining when they begin and end. Tax documentation is retained under separate rules.
  • Enquiries that do not result in an order: while the enquiry is being handled, then for 12 months after correspondence ends.
  • Unnecessary working files and rejected design versions are deleted no later than 90 days after order fulfilment ends. The approved visual preview remains part of the order documentation. Designs for enquiries without an order are subject to the 12-month period from the end of correspondence.
  • Routine technical logs are retained for 90 days from recording.

In the event of a complaint, dispute or incident, we retain longer only the data needed to handle the matter and protect rights, for a period justified by the proceedings and applicable law. This does not automatically extend retention of other data.

Detailed purposes, legal bases and customer rights are described in the privacy policy. Data retention periods do not extend or limit statutory complaint rights.

Changes to these terms do not affect rights under contracts already concluded. Each order is governed by the version accepted when the contract was concluded. Mandatory consumer rights take precedence over any conflicting provision. The choice of Polish law does not deprive consumers of protection under mandatory rules applicable under private international law.

Legal basis: the Polish Act on Consumer Rights, consolidated text published in the Journal of Laws of 2026, item 1244, taking account of amendments in force.
